Debarment was proposed because a USDA Office of Inspector General \n(OIG) investigation revealed that CAPELLAN, DIAZ, and GUILIANO \nengaged in a scheme whereby they purchased produce on credit from \ngrowers for resale but failed to remit payment. \nWhen growers and/or shipping companies pursued payment through email and/or phone and text messages, CAPELLAN, DIAZ, and \nGUILIANO ceased all communication. After a certain amount of time \nand claims made against a certain company name, CAPELLAN, DIAZ, \nand GUILIANO would “close” that company and open a new company \nunder a new and “clean” name. \nAs a result of the scheme, victims lost more than $973,000 in unpaid \nproduce and shipping orders.
