Debarment was proposed because on September 1, 2020, Channing \nStrother (STROTHER), Chief Administrative Law Judge, issued a U. S. \nDepartment of Agriculture (USDA) order to CMF (for CMF’s failure to \npay assessments from 2017 to 2019) to pay $89,246.55 to the Mushroom \nCouncil and $5,000 to the Treasurer of the United States. \nOn November 9, 2021, STROTHER issued a USDA order for CMF’s \nfailure to pay assessments from January 2020 to November 2020, and \nhe ordered CMF to pay $24,812.53 to the Mushroom Council and \n$5,000 to the Treasurer of the United States. \nCMF’s ongoing failure to pay debts owed to the government or \ninstrumentally the Mushroom Council, misconduct for failing to pay \nrequired assessments, failure to maintain records, and report required \ninformation to the Mushroom Council on eleven occasions established \ncauses debarment governmentwide debarment under 2 C.F.R. § \n180.800(d), as this misconduct constituted a cause of so serious or \ncompelling nature as to affect present responsibility.
